A fiction similar to reality

"Assessing Declaratory Embargoes filed to remedy the omission of the historic decision, announced here, issued on 09/03/26, which, in one of the many actions brought by institutions and organizations defending Human Rights and social movements, recognized the responsibility of the then President, elected in 2018, by 55.205.640 votes, for the thousands of deaths that occurred during the pandemic period, in the years 2020 and 2021, the STF, in yet another memorable demonstration and, this time, with surprising unprecedentedness, recognized the joint responsibility of various entities and people for the same fact.

Starting with a self-criticism, so essential in times of historical balance, he admitted that much more could have been done to minimize social chaos, both with regard to the immediate accountability of public managers, and because of having, in various decisions, assimilated neoliberal values contrary to the pacts of solidarity and social justice established in the Federal Constitution, admitting that this contributed decisively to the precariousness of working conditions, the general impoverishment of the population, the collapse of public health services, at the same time that it promoted the enrichment of a tiny portion of the population and, above all, of large multinational companies, aggravating the situation of virus contamination.

He even extended this criticism to the Judiciary as a whole for having, in several pronouncements, corroborated – and with that even encouraged the edition – laws and measures contrary to the constitutional project, giving vigor, for example, to the euphemistically named labor “reform” of 2017 (which decimated social rights, stimulated telecommuting and with no provision for limiting working hours – which caused enormous physical and psychological damage to those who, during the pandemic, started to work at home, reaching, due to the accumulation of tasks, above all, working women –, obstructed access to justice and destroyed unions), declaring the validity of unlimited outsourcing, authorizing the reduction of wages by individual agreement, practically eliminating the incidence of interest and monetary correction on labor debts, and acting in the same way regarding the so-called social security “reform”. He also recalled that, in many decisions, even if occasional, in the name of defending values ​​such as the “free market” and “non-intervention of the State in social relations”, the Judiciary, in many moments, prevented the implementation of measures of restriction that could reduce the number of deaths (as in the case in which the request for the supply of masks and gel alcohol was denied, in addition to a minimum remuneration for drivers and couriers by apps), reaching the point of having witnessed the proliferation of countless determinations of an administrative nature that, in attachment to a supposed “contractual freedom” and under the foundation of legal regularity, “revoked” judicial decisions, which, making use of constitutional precepts, sought to inhibit the autophagic promotion of collective dismissals of workers( to the). He also highlighted that scientific studies, already published at the time and which were later confirmed, demonstrated how the proliferation of precarious work and unemployment helped to advance the pandemic.

Na sequência, na mesma linha do levantamento dos fatos históricos, o STF declarou a responsabilidade solidária: a) dos empregadores (notadamente grandes empresas e instituições financeiras) que buscaram naquele período manter suas margens de lucro – ou até majorá-las – por meio da adoção de formas precárias de contratação e da exploração do trabalho sem o respeito aos direitos trabalhistas essenciais à preservação da saúde, como garantia de emprego e salários, limitação da jornada, obediência às normas de saúde e segurança no trabalho ou até mesmo pela negação do reconhecimento do vínculo de emprego (caso, sobretudo, das empresas proprietárias de aplicativos); b) dos governadores e prefeitos que, na inércia do governo federal, também não promoveram as medidas de restrição necessárias para barrar a transmissão do vírus e até, ao contrário, impuseram, em alguns casos, a continuidade do trabalho presencial, desconsiderando as condições de morbidade dos trabalhadores(as) e até desprezando o conceito de atividade essencial, como se verificou com a continuidade dos campeonatos de futebol durante a fase roxa da quarentena; c) dos congressistas que silenciaram diante de tudo isso e ainda corroboraram as iniciativas governamentais de diminuição do Estado brasileiro, de modo a ruir os serviços públicos em geral e a minar os sistemas públicos de saúde, educação e tecnologia, tudo em favor da iniciativa privada internacional (apropriadora de divisas), aumentando a desigualdade, o sofrimento e a crise sanitária; d) de todas as pessoas que silenciaram a respeito da necessidade do afastamento imediato do Presidente da República porque, valendo-se da fragilização política do Presidente e também de todos os fantasmas gerados pelo caos social e econômico (distopia, darwinismo social, medo e egoísmo, estimuladores da “doutrina do choque”), procuraram, naquele contexto, de algum modo, atingir um benefício próprio, tais como: liberar, sem qualquer limite, a pauta da denominada “agenda liberal”; aumentar a exploração do trabalho; valer-se do fundo público para reduzir custo de produção sem preservar o valor integral dos salários e os empregos de seus empregados; auferir dividendos eleitorais para 2022, contribuindo, assim, para o prolongamento das tragédias cotidianas; obter isenções de tributos; implementar privatizações, liberação do porte de armas e supressão das barreiras ambientais; atingir uma preferência na vacinação; e até mesmo adquirir o domínio privado das vacinas; e) das entidades (públicas e privadas) e pessoas que reproduziram ou conceberam como normais (ou necessárias) práticas antirrepublicanas, antidemocráticas, punitivas e arbitrárias, reprodutoras da desigualdade, do elitismo, das diversas formas de opressão, do preconceito, da discriminação, da intolerância, da indiferença, do ódio e do egoísmo, aniquiladoras, portanto, da coesão humana fundamental para a superação de um drama humanitário; f) daqueles(as) que, por quaisquer razões, econômicas, políticas ou ideológicas, prestaram seu expresso apoio – e, inclusive, pleitearam na Justiça o “direito” de assim se postarem na vida social – à negação da adoção das prevenções, das medidas restritivas e da vacinação; e, por fim, g) de todos e todas que não se manifestaram ou agiram a respeito porque quiseram continuar levando a sua “vida normal” ou preferiram acreditar na chegada de um salvador messiânico ou, simplesmente, não quiseram se envolver com tudo isso, dizendo ser muito chata a política e também acreditando que não seriam atingidos, mesmo que o número de mortes continuasse batendo um novo recorde a cada dia".

OBS: This news is a work of fiction and any resemblance to reality is mere coincidence, not least because the future can be much darker than this one, if you still continue to bet all your chips on the structures (public and private) that act for the maintenance of the “status quo”, or it could turn out to be much better if, aware of the chaotic course of events, the working class, inspired by the spirit of solidarity, real equality, tolerance, concrete freedom and love, recovers the reins of history.
